George Town

A pregnant housewife and her mother were charged yesterday for trafficking 882gm of heroin at a bank on 5 December 2008.

27-year-old Hwei Wen Chiu and 50-year-old Lim Ah Mooi, 50 are alleged to have committed the offence at the Beach Street branch of the RHB Bank Bhd at 11:20am that day. No plea was taken while Hwei’s mother was unrepresented.

Under Section 39B of the Dangerous Drugs Acts 1952 carries the mandatory death sentence upon conviction, states that no bail may be posted. Hwei’s lawyer Jagdeep Singh Deo applied to the court under Section 388(1) of the Criminal Procedure Code to allow Hwei bail because she is two months’ pregnant.

Assistant Public Prosecutor Nor Afidah Mohd Sarayany raised an objection to the application and Magistrate Noor Fadzila Ishak denied Hwei bail.

Jagdeep Singh then requested the court to fix an early mention date and that he would make a representation to the Attorney-General’s Chambers on the urgency of the case.

Noor Fadzila fixed 8 January 2009 for mention once the representation and the chemist’s report are ready.
