Nurin Murder Case: Negligence Suit Against Police and Government

16 January 2010
Kuala Lumpur

36-year-old Jazimin Abdul Jalil, father of Nurin Jazlin Jazimin, will be filing a negligence suit against the Malaysian police and Government over the post-mortem photographs of his daughter being exposed on the Internet.

On Monday, Judge Justice Zabariah Mohd Yusof of the High Court struck out the application by the Government to withdraw its application to strike out the suit. Senior Federal Counsel Noorin Badaruddin and SFC Zureen Elina Mohd Dom, who represented the defendants, had applied to withdraw their strike-out application and asked for RM10,000 in compensation.

Jazimin’s lawyer, Harjinder Singh Sandhu, objected to the compensation and said that he will present to court an application by his client on 29 January 2010 to include the name of a policeman who allegedly caused the online circulation of his daughter’s post-mortem photographs.

On 1 December 2009, Jazimin filed a summons to name Lance Corporal Amran Arifin as the fifth defendant in his suit. Earlier on 21 August 2008, he had named the Inspector-General of Police, the Selangor police chief, Petaling Jaya district police chief and the Government as defendants as well.

Jazimin claimed that in September 2007, the post-mortem photographs were passed to the defendants for investigation purposes. His 8-year-old old daughter had gone missing on 20 August 2007 in Wangsa Maju and suspected to be a victim of abduction and murder. It is learnt that an e-mail containing the photographs was circulated on the Internet.

In their statement of defence, the defendants stated that Lance Corporal Amran had brought home draft copies of those photographs and showed them to his neighbour. The neighbour’s relatives later took photos of them using a mobile phone camera without Amran’s knowledge. It is claimed that those people then posted the photos online.
