The High Court trial for the murder of Mongolian Altantuya Shaariibuu started yesterday with the prosecution putting Abdul Razak Baginda and C/Insp Azilah Hadri as the masterminds and the inspector and his subordinate Kpl Sirul Azhar Umar carrying out the deed.

DPP Tun Abdul Majid Tun Hamzah said his team would produce evidence to prove that Abdul Razak had known the Altantuya since 2004, and frequently met her and gave her money. When their relationship ended in August 2005, Abdul Razak continued to give her money until early 2006. Altantuya then hired a private investigator to track down Abdul Razak and came to Malaysia several times to demand money from him.

When Altantuya arrived in Kuala Lumpur in 8 October 2006, she tried to meet Abdul Razak but was denied. She sent several threatening notes to him and Abdul Razak hired a private investigator to keep her away.

Abdul Razak then met C/Insp Azilah at his office at the Bangunan Lembaga Getah Asli on 18 October 2006 to confide in him. Together, they were alleged to have planned Altantuya’s murder. Tun Abdul Majid said a note found at C/Insp Azilah’s office with Altantuya’s name, address, phone number and the name of Abdul Razak’s private investigator would serve as evidence that the officers had gone to Hotel Malaya where she was staying.

Altantuya was believed to have gone to Abdul Razak’s house on 19 October 2006 and was held up by the private investigator, as instructed by Abdul Razak. The officers then took her away and were the last ones seen with the deceased.

The DPP then put it that Altantuya might have died from “blast-related injuries”, which is in contrast to the widely believed cause of being shot dead.

To support their case, the prosecution will make use of a confession made by Kpl Sirul Azhar to his superior, and also on some items belonging to the deceased found in his house. A pair of bloodstainded slippers was also found in his car, which matched the deceased’s blood DNA.

Customs superintendent Abdul Malik Stawasil has been sentenced by a Sessions Court to 4 years’ jail and fined RM125,000 for two counts of bribery. He was found guilty of accepting RM20,000 from Ho Sook Fong, the owner of Roover Car Care Centre. In return, Abdul Malik would not take action against Ho’s company which did not pay service tax.

The Internal Tax Enforcement Unit officer had committed the offence at the Customs department’s car park in Pusat Bandar Damansara at 4pm on 20 February 2003.

He was also found guilty of receiving another RM5,000 as bribe from Ho as an inducement not to take action against his company which did not have a service tax licence at the company premises at Sungai Chuah industrial area in Kajang at 1:45pm on 8 March 2003.

The judge had sentenced Abdul Malik to two years’ jail for the first offence and another two for the second, but the jail terms will run concurrently.

54-year-old Ahmad Tarmizi Mohd Husin has been sentenced to 15 years of jail time each for causing the deaths of sawmill owner Leaw Chong Kit and his wife Leong Guet Hwa, both aged 43. Ahmad Tarmizi had robbed the couple of their valuables in their house at Taman Intan Jaya, Teluk Intan at 6am on 15 February 2002. He then stabbed the couple to death.

The judge has also sentenced him to 9 years’ jail for grievously injuring the couple’s son Alexander while robbing the mother’s purse, a mobile phone and a watch at the same incident.

The teenager, who was 17 years old then, was stabbed several times together with his father when they were trying to stop Ahmad Tarmizi from escaping. Alexander survived the chest and hand injuries but Leaw died from blood loss at chest, liver and abdomen stab wounds. Leong was stabbed fatally in the neck when she struggled with the burglar.

In total, Ahmad Tarmizi has been sentenced a total of 39 years’ jail but the sentences are to run concurrently from 20 March 2002.

He claimed trial for the murder of the two, but the Deputy Public Prosecutor had changed the charge to manslaughter. He pleaded guilty to this charge.

Ahmad Tarmizi has been in and out of jail since 1972 for at least five counts of housebreaking and six drug possession offences.
