The prosecution team led by DPP Tun Abd Majid Tun Hamzah has applied to impeach DSP Yusri Hasan Basri for his contradictory evidence given between his testimony in court and his police statement.

Yusri was a Special Action Squad (UTK) operative and a colleague of accused Corporal Sirul Azhar Umar. He accompanied the Bukit Aman serious crimes division (D9) investigation team to obtain UTK items at Azhar’s apartment on 7 November 2006.

As it was his first time testifying in court, Yusri explained that was nervous when giving his testimony. His police statement was taken by investigating officer ASP Tonny Lunggan on 2 and 3 August 2007, after the murder trial began in June. However, Yusri told the High Court judge Datuk Mohd Zaki Md Yasin that he had forgotten the events at Azhar’s apartment as it occurred nine months ago.

The prosecution pointed out four contradictions.

In his police statement, Yusri said he was not clear if Azhar was brought into his own room as Yusri was searching for UTK items at that time. In court, Yusri stated that Azhar was not brought into the room the entire time that Yusri was in there.

The second contradiction involved Yusri’s statement in court that Azhar was not in the room while the D9 officers were searching the room, but in his police statement, he said that he was unsure if Azhar was there.

Yusri recorded in his police statement that he entered the apartment after the D9 officers, while in court he testified that he entered the apartment together with the investigating officers.

The last contradiction was between Yusri’s police statement that the Bomb Disposal Unit had entered the apartment after him and his statement in court that he was not sure if the Unit had entered the apartment at all.

Zaki will announce his decision on the trial-within-a-trial at the end of the prosecution’s case.

Police have uncovered a vice den in an orchard in Kanchong Darat, some 10KM from Banting. Surrounded by an oil palm estate and a pig farm, businessmen and salespersons have been patronising the place known as Shi Wai Tao Yuan, meaning Peaceful Haven in Chinese. On Tuesday night, police raided the place which is suspected to house 20 Chinese national women who have been operating there for two to three months.

12 wooden huts were built for clients to reside in, which were decorated with karaoke sets and coloured lights. A house nearby was used to prepare food and drinks for clients.

The den gain attention when police received complaints from villagers that many cars were going in and out of the plantation.

30 clients were present during the police raid, enjoying beer, cigarettes and music at that time. Police arrested 6 China national women and a 30-year-old local man while the rest fled into the near plantation. The women entered the country as tourists and did not have valid work permits. Statements were taken from the 30 clients, including a 47-year-old Singaporean, who were later released.

Police also seized RM3,500 cash, RMB3,300 cash (RM1,500), four mobile phones and a set of handcuffs from the local suspect.

29-year-old Tan Lee Sang was near his car at a railway station car park on Tuesday 10:30pm when three robbers forced him into the car. One of them hit his head with a bottle and the other two, holding parangs, sat with him at the backseat.

They took him to a dark alley where they robbed him of four mobile phones, RM800 cash and other currencies, and three ATM cards. Then, Tan was put in the car boot after they have gotten the PINs for the ATM cards.

The robbers proceeded to make a few stops at banks to withdraw cash using Tan’s ATM cards. During one of the stops, Tan used a torchlight and pried open the boot. When he got out, he started shouting for help. Two police patrol cars arrived a few minutes later but the robbers had escaped in his Toyota Vios vehicle.

Tan sustained two stitches on his head and several injuries to his hands and body.

The robbers had taken Tan’s watch, shoes, passport and RM1,300 using two ATM cards.
