Taxi Driver Asks for Cab Fare After Raping Customer

A taxi driver who had raped a 28-year-old clerk a few times had the cheek to demand that she pay for the cab fare for the trip to her home.

The victim had got into the taxi after work in Bandar Utama on Tuesday at 9pm. Although the taxi driver was instructed to drive to Section 17, Petaling Jaya, he drove the victim to a deserted area in Sentul. Once there, he managed to handcuff the victim, stripped her naked and raped her a few times.

The taxi driver then proceeded to drive her back to Section 17 at 4:30am. When he demanded for the cab fare, the victim told him she had to go into her house to get the cash. When the victim went into the house, she alerted her uncle who rushed out to confront the taxi driver.

A fight broke out between the men before the taxi driver sped off in his taxi as he tried to knock the victim’s uncle down.

The victim was brought to the Petaling Jaya police station by her uncle where they lodged a report. She was then sent to University Malaya Medical Centre for a medical inspection.

Altantuya Murder Trial: Witness Statement Application Rejected

High Court judge Justice Mohd Zaki Md Yasin has dismissed an application made by counsel for murder accused Corporal Sirul Azhar Umar, Kamarul Hisham Kamaruddin, to obtain the witness statement of DSP Musa Mohd Safri from the prosecution team. Kamaraul reasoned that the statement of the senior police officer, who is a minister’s aide-de-camp and political analyst Abdul Razak Baginda’s friend, will be critical to prepare for Azhar’s defence.

Kamaral said DSP Musa would be an important prosecution witness and could be cross-examined by the defence. Deputy Public Prosecutre then argued that the witness statement was a privileged document.

Justice Mohd Zaki said the new amendment to Section 113(2) of the Criminal Procedure Code (CPC) in 2006 had clearly stipulated the condition relating to the supply of the document to the accused person. He found that the 112 statements applies to all stages of trial including one of the defence.

At the beginning of the trial, an application for all 112 statements of witnesses for the prosecution be provided to Azhar was rejected because he was bounded by an apex court ruling that the statements were privileged.

Justice Mohd Zaki set 2 February 2009 to continue with the hearing.

School Teacher Charged with Sodomy

A primary school teacher was charged under Section 377C and Section 377A of the Penal Code for sodomising a 14-year-old boy and forcing him to perform oral sex on him.

30-year-old Badrul Akmal Ishak claimed trial yesterday to the charges of committing carnal intercourse against the order of nature at a house in Taman Kembara 2, Rantau Panjang, in August 2008.

If found guilty, Badrul Akmal may be jailed up to 20 years and caned for each charge.

Deputy Public Prosecutor Aimi Syazwani Sarmin proposed to deny Badrul Akmal bail, fearing that he may harass the victim if he is not detained. Badrul Akmal’s counsel, Gerard Lazarus, then argued that his client had not gone near the victim when he was on bail following his arrest.

Judge Yong Zarida decided to fix bail at RM5,000 in one surety for both offences and prohibited Badrul Akmal interacting with the victim in any way. The teacher is also required to report to the nearest police station on the first Saturday of every month until the conclusion of the case. Trial date has been set to 3 March 2009.
